Please read the following Retail Store Terms (“Terms”) carefully. This document determines the terms and conditions of using the Taiwangun.com Store (“Store”) as well as the rules of forming sales agreements between the Buyer (“You”, “User”, “Buyer”,) and us, the company under the name of Krakman P. Kiepura, K. Michalik sp. k. (“Krakman”, “We”, “Seller”), located in Poland (Pollanki 18, 30-740 Krakow, Poland, tel. +48 123626134, e-mail: shop@taiwangun.com), added to the Register of Entrepreneurs by the District Court of Kraków – Śródmieście, XI Commercial Department under KRS 0000567135, REGON 122593008, VAT PL6793082897.
Account registration
Account registration is not obligatory. Nevertheless, we advise you to register a free account in order to access the Store’s full functionality.
All data provided during the registration process needs to be correct and complete. Failing to meet this requirement may lead to account suspension or deletion.
Prices and local taxes
The prices at the Store, as well as any local tax rates, depend on the destination country. If the shipping address is located within the European Union, the prices will be displayed in gross values and they will include VAT.
For countries from outside the EU as well as for territories with special VAT status, net prices will apply. Based on our experience, in the shopping cart as well as the FAQ page, we will inform the Buyer about the possibility of additional taxes being levied upon import or about other restrictions. This, however, should not be treated as binding. Verifying and paying any local taxes and duties is the responsibility of the Buyer importing the goods.
Limits of quantity
As the order is being completed, stock availability is verified one final time. In case a quantity correction is necessary, the Buyer will be notified about the unavailable items and asked if the Seller should proceed with dispatching the remaining, available part of the order. If the Buyer confirms, the order will be fulfilled partially and the Buyer will be refunded for the unavailable items.
Preorders, backorders
Products marked as pre-order or backorder may be available to be purchased with delayed fulfillment. The delivery time of such orders will be extended accordingly. The payment will be required upfront when placing the order.
Krakman makes every effort to meet the planned dates and deliver products within the estimated time, however delays may arise. The Buyer may resign from the order and cancel it at any point until the fulfillment starts.
Billing and payments
Payment methods available at the time of the purchase will be displayed on the checkout page. They may include, among others, online payments, cards, PayPal, bank transfer and cash on delivery.
For a prepayment order to be fulfilled, one of the two conditions needs to be met: either the Buyer’s bank transfer needs to be booked on Krakman’s account, or Krakman needs to receive a notification from an online payment service about the Buyer’s payment.
If the cash on delivery option is selected, the Buyer is obliged to pay the amount in question to the courier during the delivery.
Orders that are pending payment will be canceled after a maximum of 7 days if the amount due is not paid.
Placing orders
All content available at Taiwangun.com, including images, descriptions and prices does not constitute an offer as defined by the Polish Civil Code. Placing the order by the Buyer is understood as making an offer as defined by the Polish Civil Code.
Placing an order will be followed by receiving an automatic e-mail summary. This e-mail does not constitute accepting the order and confirming the offer by Krakman.
Concluding the sales agreement between Krakman and the Buyer takes place when the Buyer receives an e-mail message informing that the fulfillment has begun.
Wholesale orders
For long-term wholesale cooperation, please create an account on the wholesale platform Taiwangun.biz, which is better prepared to handle business orders that are directly related to the conducted business activity.
Occasional business orders placed on the Retail Store may be fulfilled. If a business order is directly related to your conducted business activity, the order may be shipped on a pallet and promotions intended for retail customers (e.g. free shipping threshold, discounts) may not apply. For shipping within the EU (excluding Poland) and after the company's EU VAT number is verified, the VAT rate will be adjusted to 0%.
Editing orders
The Buyer may cancel or make changes in the order before the fulfillment starts. Please contact us as soon as possible in such situations.
If the order is completed, please exercise your right to withdraw from the contact entirely (in case you wish to cancel the order), or partially (in case you need to adjust the quantity), referred to later in these Terms.
Fulfillment and shipping
Packages are prepared for shipping within 1-2 business days from confirming the order, unless other arrangements are made as the order is confirmed.
The cost of a courier shipping is calculated as the order is placed and is based on the weight of the products. The shipping cost is covered by the Buyer as a lump sum. The Seller will provide a tracking number so that the Buyer can track the package.
Free shipping of orders meeting a minimum value threshold may be offered in selected countries.
If an estimated delivery time is provided, it is based on experience from previous shipments to that country and is not guaranteed. The preparation and delivery time may be longer, especially during periods of increased activity, such as the Christmas period or Black Friday.
Should circumstances force the Seller to use a shipping method different to the one selected by the Buyer, the Buyer will not be charged with any additional costs other than these that they accepted to cover initially. The Buyer will be refunded for any amount that is surplus in relation to the cost of the shipping method used by the Seller.
Check shipping costs and methods
Modifying replicas and other services
At the Buyer's request, the Seller may perform additional services or modifications of selected items within a limited scope, which includes, for example, adjusting the muzzle velocity (FPS).
All such modifications and services will involve disassembling the product, which may leave permanent marks (such as marks made by a screwdriver or by pulling two elements apart). By requesting such modifications, the Buyer confirms that no claims shall be made due to such marks.
Custom modifications to replicas requested by the Buyer affect the right to withdrawal from the contract. In accordance with the appropriate regulations, the right to withdraw from the contract is not granted to the Buyer for contracts, where the subject of the contract is a non-prefabricated item, custom-made to the Buyer’s specification (such as an item with custom parts installed on the Buyer’s request).
Returns, withdrawal from the contract
The Buyer has the right to withdraw from the contract within 30 days of receiving the ordered product(s), without having to provide the reason for the return. Exclusions to this right are described in the section “Modifying replicas and other services” and other cases, when the Buyer is not entitled to withdraw from the contract.
Please fill in the return form in order to communicate the wish to return a product. You can also submit such a request via shop@taiwangun.com or in writing to Krakman’s address.
The Buyer is obliged to send the product to Krakman shortly after notifying the Seller about the withdrawal, no later than within 14 days. The shipping cost is covered by the Buyer.
The returned goods should be complete and packed in a secure manner. The Buyer is responsible for any loss of value of the returned items (such as signs of use, damage or missing parts), and the Seller reserves the right to deduct an appropriate restocking fee from the refunded amount as compensation.
The Seller commits to refunding the Buyer in a timely manner, no later than within 14 days. The refund will be issued via the same payment method as used for the original purchase, unless explicitly stated otherwise.
Complaints and claims
Undelivered parcels
The Seller is responsible for delivering the order. If the package is not delivered two weeks after the estimated delivery time, the Buyer should contact the Store’s customer service.
Krakman is not responsible for parcels delivered to the wrong address, if said address was provided by the Buyer. We make every effort to verify the shipping addresses, but it is the Buyer’s responsibility to provide correct and comprehensive shipping address information.
If the parcel is returned to the sender due to an incorrect address, due to the failure of paying due duties or taxes upon import, or due to the refusal of the package by the Buyer, the Buyer may be charged for the return shipping, for the duties or taxes due, if they were pre-paid by the carrier, as well as for the second shipping from Krakman to the Buyer (if applicable).
If the non-delivery is a result of an error on the Seller’s or the carrier’s side, the cost of a second shipping is covered by the Seller.
Damaged parcels
In order to facilitate the complaint process, please check the shipment and the condition of the contents at the time of delivery. In case of damage, please fill out the relevant damage report in the presence of the courier. A copy of this form, together with photographic evidence, should be sent to us via shop@taiwangun.com on the same day.
Fulfillment errors
Any discrepancies between the ordered and and the received products should be reported immediately.
Non-conformity of goods, defects of goods
In case of non-conformity of goods with the contract, the Buyer may exercise the statutory warranty rights specified in detail in the relevant laws. The deadline for exercising these rights in the European Union is two years from the date of the delivery of the product. In addition, if the warranty was granted for the given product, the Buyer may exercise the warranty rights.
The rights granted by the statutory warranty and the rights granted by the warranty do not exclude each other - the Buyer can choose the preferred type of the claim. Damage and faults that are a result of misuse, random accidents or self-modification are not covered by the warranty or the statutory warranty.
Please fill in the complaint form to report a non-conformity of the goods with the contract. You can also submit such claim via shop@taiwangun.com or in writing to Krakman’s address.
The complaint should clearly state the Buyer’s demand, as well as it should describe the nature of the problem and the circumstances in which the problem was detected. The Store’s customer service may ask for additional information, depending on the nature of the problem.
Claims will be reviewed within 14 days of receiving them. If the nature of the claim requires inspecting the product, the Seller will inform about such requirement and the Buyer will be obliged to securely pack and send the product to Krakman’s address, or, if so indicated, to a different address specified by Krakman.
The return shipping cost is covered by the Seller. The seller provides a prepaid shipping label if the Buyer is located within the European Union. For other countries, the Seller, at own discretion, reimburses the shipping cost, up to 50 USD, or arranges an appropriate repair or service locally. Cash on delivery packages will not be accepted.
Repairs and verifying faults may leave visible marks (e.g. due to using a screwdriver or sliding two elements apart). The Buyer acknowledges that such marks can not be a basis of any claims.
If the claim proves to be unjustified (the product in question is conforming with the contract, not faulty), the cost of shipping the product back from Krakman to the Buyer is covered by the Buyer.
Merchandise that remains unclaimed by the Buyer after the date specified in a notification from the Seller is stored by the Seller at the Buyer's expense, beginning from the day following the specified collection date. The amount is based on the market value of such storage and is equal to 90 PLN per month for every full month of storage and 1/30th of this amount for each day, if the item is not stored for a full month.
Dispute resolution
Any disputes between the Buyer and Krakman shall be subject to resolution by common courts of law. The Buyer who is a consumer may use the out-of-court way of dispute resolution and assertion of claims before the Permanent Consumer Court of Arbitration at the appropriate Provincial Inspectorate of the Trade Inspection, by submitting a relevant motion (i.e. a motion for instituting and conducting mediation or a motion for examining the case by an arbitration court). The forms of the relevant motions are available at the UOKIK website (in Polish).
Merchandise
We do not sell firearms. All the products visible in our offer (which may resemble firearms in name, appearance or description) are replicas meant for recreational use, particularly for airsoft games. Likewise, the remaining part of the products, including optics and tactical gear, are also replicas of their counterparts.
Replicas may differ from their real counterparts (in materials, functionality, specification, mode of operation or other characteristics) and such differences do not constitute valid complaints.
Some of the offered products may include batteries or compressed gas containers. By purchasing such products, the Buyer confirms that he/she understands that the use and storage of such items involves risks and requires special precautions as described in the instructions for use and storage.
The Buyer is responsible for meeting any relevant, legal requirements concerning owning airsoft gear in the given area (e.g. having an appropriate license, ensuring that the replica has a serial number engraved, registering the replica in the appropriate body).
Products sold at our store are meant for adults only.
Privacy policy
Please familiarize yourself with the privacy policy to see the extent to which we gather and process data.
Product reviews & other User content
Users may add and post their own content such as product reviews or questions.
By adding such content, the User grants Krakman a non-exclusive, unlimited in time license to use, process and publish the content of reviews and questions, or their fragments. Proprietary copyrights and dependent rights are granted to Krakman without territorial limitations and with no financial gratification to the User.
Authenticity of product reviews
Buyers are invited to leave reviews about the purchased products. Moreover, to ensure the authenticity of product reviews, the Seller has implemented the following technical measures applicable jointly:
- adding an opinion is possible only by the Buyer of a given product,
- the opinion adding form is available to registered Users,
- the Store is protected by tools that automatically detect fraudulent behavior (reCAPTCHA).
User content requirements
Product reviews and other content added by Users may not include:
- prosecution, obscene, pornographic or hateful content, racism, xenophobia,
- contact details or personal information,
- website addresses or advertising content,
- characters that make it illegible, but not special characters specific to the language of the review.
Krakman shall have the right to publish the reviews and questions, to correct them grammatically, to anonymise them as well as to decide about the first publishing date.
The Seller does not interfere with User content, however, it reserves the right to remove or block the possibility of publishing them in justified cases when:
- they violate the provisions of the Terms regarding prohibited elements,
- were mistakenly added to the wrong product, if their content clearly indicates a mistake,
- the content of the opinion clearly indicates a mistake as to the rating given,
- is copied in whole or in part from other Users, the manufacturer of the reviewed product or from other available sources,
- the user has not used the product, which is clear from the content, the time it was added or the course of the transaction,
- the content of the review contains characters that make it illegible, but this does not apply to regional characters specific to the language in which the review was issued.
Newsletter
Users may receive commercial and marketing content (for example in the form of e-mails - newsletter), if they granted Krakman permission to receive such content.
Consent to receive marketing materials can be withdrawn at any time by changing settings in the User’s account or by clicking an appropriate “unsubscribe” link in one of the e-mails.
Account termination
Krakman reserves the right to close or delete the User’s account if the User does not comply with the Terms otherwise misuses their account.
Miscellaneous provisions
Currency exchange rates, prices, product descriptions, photos, promotions and any other element of the website’s content, as well as any aspect of the offered service, may be changed without any prior notice and at any given time. The state of the website and of all its contents at the moment of placing the order is considered binding.
We make every effort to ensure that all the information visible at the Taiwangun.com website is updated, complete and correct, however we cannot guarantee that this is always the case.
As any website, Taiwangun.com is vulnerable to unforeseen technical issues, glitches or errors. We reserve the right to cancel any orders containing irregularities (e.g. in prices, quantity or other) which were a result of such glitches or errors.
Any changes to these Terms apply to User activity after the given change, including orders placed after the change. If the Terms were changed, the User confirms accepting the current terms after placing a new order or during other activity on the website. Orders placed before changing the terms are subject to the Terms being in force at the time of placing the order.
